This course is focused on the prosecution cases and enforcement actions that can arise out of the work of Environmental Health Departments in the important area of environmental protection ranging from noise to waste. The course will be split into three sessions and will start with a refresher of the basic prosecution mechanisms which are applicable to all types of prosecution work. It will then focus on Environmental Health case work and consider some of the relevant legislation, offences and enforcement actions using practical examples where possible.
The course will cover:
Basic foundations of all prosecutions, procedure and considerations of the relevant Codes, Guidance and Procedural Rules
Identifying the Defendant and the appropriate offences
Evidence, time limits, discovery and disclosure
Environmental Protection Act 1990 – potential offences
Health and Safety at Work Act 1974 – potential offences
The Primary Authority Scheme and potential issues
This course is most suitable for those who are new to prosecution work within a local authority and/or within their first few years of practice. Delegates should already have or intend to hold a right of audience in the magistrates’ court.
