The Building Safety Act 2022
The Building Safety Act 2022 (the Act) represents a radical change in the design, construction, and management of so-called ‘higher risk’ buildings. It enacts the recommendations of the UK Government’s review into the Grenfell Tower tragedy of 2017. The Act received Royal Assent in April this year and is expected to be in force within stages, over an 18-month period in both England and Wales. Iwan Jenkins will give an overview of the legislation focusing on key aspects in a construction context. It really should not be missed.
Clarity at last? The implications of collateral warranties being considered “construction contracts” under the Construction Act.
For years it has been unclear as to whether a collateral warranty is a “construction contract” within the meaning of s.104(1) of the Housing Grants, Construction & Regeneration Act 1996. Tom MacSwayne will look at the recent decision in Abbey Healthcare (Mill Hill) Limited v Simply Construct (UK) LLP [2022] and the implications this may have on the construction sector.
The cladding crisis: who pays?
Matthew Stevens will review the recent case of Martlet Homes Limited v Mulalley & Co Limited [2022] where the Court awarded a housing association substantial damages in a claim relating to defective cladding.
